Workmanship Warranty

LIMITED WARRANTY

10-Year System Warranty. Under normal use and service conditions, the System will be free from defects in workmanship or defects in, or a breakdown of, materials or components for a period of ten (10) years from installation.

Roof Penetration Warranty. If we penetrate your roof during a System installation, then all roof penetrations will be watertight. This warranty will run for a period of ten (10) years from installation. This warranty will run the greater of, a period of ten (10) years from installation or the length of your current roof warranty.

Manufacturer’s Warranties. Element Solar hereby assigns all manufacturers and supplier’s warranties to you, effective as of the time the System is completely installed.

Remedies. If Element Solar breaches the limited warranties described above, we will repair or replace any defective part, material or component, or correct any defective workmanship, or repair damage to your property that we cause, at no cost or expense to you (including all labor costs). You must submit a valid claim to us in writing under this Limited Warranty. Element Solar may use new or reconditioned parts repair the damage when making repairs or replacements. Element Solar may also, at no additional cost to you, upgrade or add to any part of the System to ensure that it performs according to the guarantees set forth in this Limited Warranty. Cosmetic repairs that do not involve safety or performance will be made at Element Solar’s discretion.

EXCLUSIONS AND DISCLAIMER
This Limited Warranty does not apply to any lost power production or any repair, replacement or correction required due to any of the following:

Someone other than Element Solar (or its approved service providers) installed, removed, re-installed, altered, modified, serviced, or repaired the System.
You fail to provide us reasonable access or assistance in diagnosing or repairing a problem.
Any Force Majeure Event, including (but not limited to) fire, acts of nature, storm, strikes, production and/or shipment delays, material shortages, war, terrorism, government or utility regulations, permitting or inspection delays, payment disputes, change orders, financing delays, soil conditions, and/or any other matters or conditions beyond Sunfinity Solar’s control.
Shading from foliage that is new growth or is not kept trimmed to its appearance on the date the System was installed.
Any system failure or lost production not caused by a System defect (e.g. the System is not producing power because it has been removed to make roof repairs or you have required us to locate the inverter in a non-shaded area).
Theft or vandalism to the System.
Your negligent acts or omissions.
You do not maintain and operate the System in accordance with all written instructions for the operation of the System provided to you in writing at the time of installation of the System.
Normal wear and tear.
