Workmanship Warranty

25 Year Workmanship Warranty

(a) Limited Warranty. Subject to the limitations and exclusions set forth in item (c) below, Company hereby provides a Ten (25) year workmanship warranty with respect to the System and its installation ("Warranty Period").

(b) Claims. Customers shall make any warranty claims in writing to Company prior to the expiration of the Warranty Period. In the event Customer makes a valid warranty claim, subject to the limitations and exclusions set forth in this Section (c) below, Company, at its sole option, shall either: (i) repair, correct or otherwise cure, or subcontract or otherwise arrange for a third party to repair, correct or otherwise cure, the defective installation on which such warranty claim is based; or (ii) pay to Customer the reasonable cost of repairing, correcting or curing such defective installation.

(c) Warranty Exclusions. Notwithstanding anything to the contrary set forth herein, but subject to compliance with State Warranty Laws, Company specifically excludes from the limited warranty set forth in item (a) above any defects caused by or resulting from any of the following: (i) Defects caused by soil movement or erosion if the System is installed on the ground. (ii) Defects caused or made worse by: (A) the materials, Equipment or work supplied by any third party, other than Company or its subcontractors; (B) misuse, abuse, negligence, accident, vandalism, theft, or unauthorized tampering by any party other than Company or its subcontractors (C) the negligence, improper maintenance, or improper operation of the System by anyone other than Company or its subcontractors; (D) Loss or damage to the System that results from acts or God or acts of force majeure, including without limitation, fire, explosion, smoke, water escape, changes which are not reasonably foreseeable in the level of underground water table, wind, hail, lightning, falling trees, animals, vehicles, flood, earthquake, and climate changes; of (F) Damage to structure of any building or any personal property located on the Site caused by roof leaks unless such leaks are conclusively determined to have directly resulted from Company's or its subcontractor's defective installation of the System, as determined by a third-party expert mutually selected by the parties.

(d) 5-Year Limited Roofing Penetration Warranty: Installer warrants your roof against damage and water infiltration at each roofing penetration made by Installers in connection with the Installation of the System and the surrounding area of each such penetration (collectively, the "Covered Roof Areas"). Installers will repair damage to your roof and repair or compensate you for actual physical damage to your property resulting from any water Infiltration in the event of failure or defects in the Covered Roof Areas. COMPANY AND CONTRACTOR MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, CONCERNING ANY MANUFACTURED PRODUCTS INSTALLED BY CONTRACTOR, OR ITS SUBCONTRACTORS AND EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS OR USE FOR A PARTICULAR PURPOSE, AND ANY OTHER WARRANTIES TO THE FULLEST EXTENT PERMITTED BY STATE OR FEDERAL LAW. EXCEPT FOR THE LIMITED WARRANTY EXPLICITLY SET FORTH ABOVE IN THIS SECTION 18 OF THIS SALES CONTRACT, COMPANY AND CONTRACTOR DO NOT MAKE, GIVE OR EXTEND, AND CUSTOMER WAIVES, ANY WARRANTIES, REPRESENTATIONS OR GUARANTEES OF ANY KIND OR NATURE, EXPRESS OR IMPLIED, ARISING BY LAW, STATUTE, IN CONTRACT, CIVIL LIABILITY OR TORT, OR OTHERWISE, CONCERNING THE SCOPE OF WORK THAT IS THE SUBJECT OF THIS SALES CONTRACT, INCLUDING ANY IMPLIED WARRANTY AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE AS TO ANY EQUIPMENT, MATERIALS, OR WORK FURNISHED UNDER THIS SALES CONTRACT.
