Workmanship Warranty
1. Contractor warrants that the installation workmanship of the PV System described in the Solar System Purchase
Agreement signed by Contractor and Customer (the “Sales Contract”) is free from material defects in installation
workmanship for a period of ten (10) years from the Effective Date (as defined below).
2. CONTRACTOR DISCLAIMS ANY WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF
MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, OF THE PHOTOVOLTAIC
PANELS AND COMPONENT PARTS OF THE PV SYSTEM SUBJECT TO WRITTEN WARRANTIES OF
THE MANUFACTURERS (“MANUFACTURER WARRANTIES”), COPIES OF WHICH
MANUFACTURER WARRANTIES HAVE BEEN RECEIVED BY THE CUSTOMER OR ARE AVAILABLE
UPON REQUEST BY CUSTOMER.
3. CONTRACTOR DISCLAIMS ANY WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF
MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, OF THE ROOF AND ANY
COMPONENT PARTS OF THE PV SYSTEM NOT SUBJECT TO MANUFACTURER WARRANTIES.
4. FOR BREACH OF THIS LIMITED WARRANTY CUSTOMER IS LIMITED TO THE FOLLOWING
DAMAGES: LABOR AND MATERIALS PROVIDED BY CONTRACTOR AND REQUIRED TO REPAIR
DEFECTS IN INSTALLATION WORKMANSHIP, THE VALUE OF WHICH SHALL IN NO EVENT
EXCEED THE CONTRACT PRICE. NO INCIDENTAL OR CONSEQUENTIAL DAMAGES SHALL BE
AVAILABLE TO THE CUSTOMER.
5. This limited warranty extends to the Customer of the PV System, and to each transferee owner of the real
property to which the PV System is affixed (the “Transferee Owner”) during the term of this limited warranty.
6. In the event of a material defect in the installation workmanship not caused by Customer’s or any third person’s
(for whom Contractor is not responsible) misuse, neglect, or unauthorized use or repair, or any other cause beyond
the reasonable control of Contractor (including Force Majeure Events and product/design defects), Contractor
will remedy the defect in the installation workmanship within thirty (30) days of Contractor’s receipt of written
notice of the defect, without charge to the Customer or any Transferee Owner. The remedy will consist of repair
labor and materials for the defective installation workmanship but will not include any warranty work on the
photovoltaic panels and PV System component parts warranted by the manufacturers, nor will it include any work
on the roof or other structural elements surrounding the PV System.
7. When performing any work under this limited warranty, Contractor has the right, at its sole discretion, to repair
or replace all or part of the PV System using new, remanufactured, or refurbished parts or products, provided said
parts are of equal or greater quality than the parts being replaced.
8. The term of the limited warranty begins on the date that Contractor has successfully tested the PV System’s
ability to turn on (“Effective Date”) and ends on the last day of the tenth anniversary of the Effective Date.
9. Customer must deliver to Contractor written notice of each request for performance of this limited warranty at
6538 Baptist Way, East Syracuse, NY 13057.
